Sarbanes-Oxley Whistleblower

Catherine Zulfer, a former employee of playboy filed a suit against them alleging that Playboy Enterprises violated provisions of the Sarbanes-Oxley Act of 2002. The former employee reports that playboy retaliated against her for refusing to participate in fraudulent activity against Playboy’s shareholders (Katz, Marshall& Banks, LLP, 2013). Without receiving permission from the board of directors, Christopher Pachler, Chief Financial Officer, instructed Zulfer to gather one million dollars in bonuses for various corporate officers of the company.At that time Zulfer felt that Pachler was attempting to embezzle the money from the company, therefore she denied the request until it was approved by the board. Zulfer then informed Playboys General Counsel and the Securities and Exchange Commission of the request that was made by Pachler. Soon after Zulfer made the report, she claims that retaliation against her began. She was excluded from company meetings and discussions, crucial information to her position was withheld from her, and her accounting staff was diminishing (Katz, Marshall & Banks, LLP, 2013).On December 31, 2011 Zulfer was terminated, although Playboy describes it as a layoff. Issue: Did Playboy violate the whistleblower-protection provisions of the Sarbanes-Oxley Act of 2002 (â€Å"SOX†)? Rule: The Playboy Company retaliated against Zulter for refusing to participate in fraud regarding the playboy shareholders. Under the Sarbanes-Oxley Act of 2002, (SOX) one rule prohibits any employer from retaliation against and employee. Domestication and foreignization are two basic translation strategies which provide both linguistic and cultural guidance for translators in rendering culture-specific source texts into target texts. The invisibility of translator is related to theory of domestication and foreignization. In his experiences as a translator and at the same time his inspirations by German philosopher Schleiermacher, Venuti describes the role and activity of translator in British and American cultures. In fact, Venuti’s work is inspired by Schleiermacher’s essay where he moves beyond strict issues of word-for-word and sense-for-sense, literal, faithful and free translation, and considers that there is only two options to translate ‘truly’: Either the translator leaves the writer in peace as much as possible and moves the reader toward him, or he leaves the reader in peace as much as possible and moves the writer toward him (Munday: p. 46) Domestication: Domestication is the type of translation which involves minimizing the source-text foreign elements to the target-language cultural values. Foreignization, on the other extreme, involves retaining the foreigness of the original-language text. In Venuti? s perspective, the foreign elements should be highlighted by the translator to register the linguistic and cultural difference of the foreign text. The debate over domestication and its extreme method of foreignization has strongly influenced by and later developed from the time-worn controversy over literal and free translation methods (Dongfeng 2002). Literal and liberal translations are two techniques adopted to tackle the linguistic form, whereas domestication and foreignization transcend linguistic boundaries. They are more concerned with the two cultures. The former replaces the source culture with the target culture and the latter preserves the differences in both linguistic presentation and cultural connotation of the source culture (Yang, 2010).

Comparison of two Poe short stories Essay

The â€Å"Tell-Tale Heart† and â€Å"The Black Cat† are two short stories written by the author Edgar Allan Poe respectively in 1843 and 1845. The two short stories which are characterized by a gothic and mysterious atmosphere has a very similar plot setting, but how do you differ the reason for killing an old innocent man(TTH), and a sudden hanging of the cat that you used to love(BC)? Poe gives a unique opportunity to analyze the way of human behavior through his short stories, where you as a reader have to study the minds of insane individuals who claim to be sane. The atmosphere of Poe’s two shorty stories indicates a lot of fear, which makes the tension rise as the timeline develops. This is seen in both stories, even though we have one big difference regarding the order of the events; in the â€Å"Tell-Tale Heart† our starting point is in a prison or in a mental health center most likely, where the protagonist recounts the preceding actions, which has led him to the place he is now. This means that we know the whole plot of the story. This flashback-like telling technique makes the reader focus more on aspects we normally consider less important; why does the heartbeat get louder and louder? â€Å"[†¦] the noise arose over all and continually increased. It grew louder – louder – louder!†(P. 158 l. 9-10). These dark and odd aspects are quite important in the â€Å"Tell-Tale Heart†, not only because they make the story more exciting and thrilling by the anaphors for instance, but also because it leads us toward a more â€Å"right† comprehension of the protagonists` behavior; how and why is he driven to his state of mi nd? Poe’s way of writing makes the tension rise a lot towards the end. It almost feels like the text is speeding up for the reader because of the action-packed ending containing all of these repetitions and exclamation marks. Furthermore is the monologue also a central factor in both short stories affecting the atmosphere, because the protagonists enrage themselves more and more. No other individuals tries to calm them down in any way, ask how they are etc. Especially this makes them seem even crazier. In â€Å"The Black Cat† is the atmosphere also dark and frightening, but not exactly in the same way though. In contrast to the â€Å"Tell-Tale Heart† are the smaller effects not that important in â€Å"The Black Cat†. The atmosphere is  more affected directly by the protagonist whose mood seems to be changing a lot through the story. The atmosphere appears almost idyllic in the beginning when the narrator tells us about this love for animals: â€Å"I was especially fond of animals, and was indulged by my parents with a great variety of pets. With these I spent most of my time, and never was so happy as when feeding and caressing them.† (P. 1 l. 21-23), but as the protagonist starts to go out and drink he gets more and more irritable. It seems like he is aware of the changing, but he finds himself unable to reverse it somehow. The answer for this might very well be the alcohol, which gives the atmosphere a huge twist as the protagonists’ senses are attenuated and he catches the wrong impressions of his formerly loved cat Pluto: â€Å"One night, returning home, much intoxicated, from one of my haunts about town, I fancied that the cat avoided my presence.† (P. 2 l. 55-56). The negative side effects of the alcohol withdraw a condition influenced by paranoia for the protagonist. Poe has an unusual way of building up a fearful; more likely a disgusting atmosphere around hobbies containing good moral and mutual pleasure; caretaking of an old man and petting a loyal cat – not really the things we would consider evil. He does this deliberately to make the reader focus more on the protagonist’s personalities: Why would anyone hang a sweet cat or a kill an old man? The relationships are turned upside down; your friends become your enemies. If we take a closer look on the spectacular personalities we most likely indirectly make an interpretation of the protagonists who are defending their extreme behavior. This is specifically seen in the â€Å"Tell-Tale Heart†, wherein the protagonist tries to argue for his actions several times: â€Å"And have I not told you what you mistake for madness is but over-acuteness of the senses?† (P. 156 l. 27-28). The denial of the madness almost appear logic to some individuals perhaps, but you do not call it mitigating circumstances what so ever if an individual can hear the heart pounding of a dead man. This is in fact the biggest difference between the two men – the protagonist in the â€Å"Tell-Tale Heart† could as well be a woman, but he says: â€Å"You fancy me mad. Madmen know nothing.† (P. 155 L. 3). For that reason we  assume the individual is a man; a man who has planned his murder for about a week. In contrast to this has the protagonist in â€Å"The Black Cat† not planned his murderous actions at all, but carries them out in blind rage. Besides this does the two protagonists have a lot in common regarding the narration especially. They both seem unreliable; they cannot be completely accurate with everything that happened in the past, particularly the narrator in â€Å"The Black Cat† since he was intoxicated by alcohol most of the time. Both titles say a lot about the narrators as well. The title in the â€Å"Tell-Tale Heart† can be put in relation to the narrator and his own heart, because he can’t bare his own actions at last and we think that it is in fact his own heart that pounds so hard in the end of the story due to the feeling of guiltiness. This applies equally in the other short story, wherein the man is suppressed by guiltiness in the end and suddenly kills his lovely wife. Furthermore is the thematic subject almost the same as the title interpretation; the human heart cannot bare such guiltïÆ'  outwardly they both seem very confident when the police searches the house, but the inside is the guilt-feeling increasing, which reveals the protagonist’s evil acts in the end. Poe masters the gothic genre very well by creating this fearful environment; even making the home a frightening place in the â€Å"Tell-Tale Heart†, whereas he makes irrational pets rational and makes the narrators irrational murdersïÆ'  relationship turned upside down again, this time regarding outwardly behavior. He changes the abilities of human nature in the big whole, which makes the stories a bit hard to analyze and therefore we must as reader think like a psychologist to obtain a slightly right comprehension of the unique stories.

I remember the smell of cigarettes and chemicals on his clothes, and I know he enjoyed telling me stories because he used to make silly voices for all the characters. This is probably why I learned to love books, and perhaps why I enjoy poetry and drama also. We used to have a boxed set of fairy tales based on the Walt Disney cartoons, and these were my favorites. I thought there was something magical in storybooks and I used to have vivid dreams about the fantastic places in these stories. Writing was connected with pictures for me at first. I used to make pasta paintings, finger paintings, and sponge paintings and my mother encouraged me to make shapes like the letters of the alphabet. In my bedroom there was a poster with the letters of the alphabet in the shape of different animals. To this day I connect the letter d with a donkey and p with a parrot! I could write my name before I went to school, and I remember that I did not like writing with wax crayons. They are difficult to use because they do not have a well defined point, and I hated the way that the colors rubbed off on each other. In my pre-school years, then, reading and writing were connected in my mind with happy times in the family and I had a generally positive attitude towards literacy. I was happy to experiment with any new writing tools, although I do remember being in disgrace for a few days after a little experiment with some indelible markers and the wallpaper in the hallway. When I went to school I was surprised at the number of children in the class who did not seem to know what to do with a book or a pencil and p aper. I was not the best student when it came to writing, and in fact spelling is still not my strongest point, but at least I was willing to learn and I liked writing much better than math or science. Sometimes I used to buy notebooks and letter writing sets with my pocket money and my favorite toy was a post office set with tiny stamps and envelopes. The method of teaching reading in my first school involved a series of graded reading books which my parents were supposed to read with me. I hated these books because nothing exciting ever happened in them. They were usually domestic tales about children and dogs, or famous extracts from history. I remember there was one interminable story about pioneers but I don’t remember what happened in it. In my mind at that time, there was reading and writing for school, which was by definition not pleasurable, and then there was reading and writing for fun, which I did at home or in the local library and this very definitely did give m e pleasure. Looking back now with the benefit of hindsight, I think this was an unhelpful distinction, but at the time this was how I saw it. I came rather late to computers, compared to some other children in my class at school. I preferred music when I was a young teenager, and I used to listen to music until late into the night. If the breach is considered to be fundamental, then the buyer doesn’t have to accept delivery or pay for the goods. This is only if the buyer gives notice of avoidance. However, Northwest has to be given the chance to cure, even if the shipment is incomplete, as it is here (Schaffer et al., 1993). The seller has the chance to cure until the time for performance expires. This means that the seller has the chance to cure by substitution or replacement goods if it can be done by the date of performance called for (CISG Article 37). Northwest tried to cure the defect by supplying PhilOre with a Taiwanese supplier at no extra cost. That said, according to the second fact pattern, there were more delays, which were beyond both parties’ control. However, these events did not make performance of the contract impossible, only impracticable and might excuse the further delay. Johnson & Johnson’s use of Employee Resource Groups or ERGs as an organization where people who share a culture or background, for example gender, ethnic, religion or age, can meet to rejoice within their culture or address issues in relation. ERGs are often chartered organizations and have volunteer leaders and business plans that are in alignment with the organizations goals and bring value to the company. Mr. Carter’s use of ERGs at Johnson & Johnson has allowed everyone to see that they are not the same but different while trying to achieve the same goals and objectives. Just from my audit I have seen their success with women, Hispanics and many other minority situations. They truly believe in what they stand for and what they are trying to accomplish in the diversity arena. In retrospect, even though Johnson and Johnson has an impeccable reputation regarding diversity, even to the point that the company thrives from the immense diversity, it is always on the top of the list of the best places work and was one of Divers ity Incs. Top Companies for Diversity, problems arise sometimes when employees or perspective employees do not see it the same way. Examples of this come in the form of lawsuits against the company for discrimination. One case in particular, Francine Parham, vice president of human resources was always bothered that there was a lack of minorities in the high positions within the company. She filed a lawsuit claiming that she did not receive a promotion because she is African-American and was then fired for speaking out against â€Å"a corporate culture of discrimination† (Gordon). Perham stated that in the lawsuit that she was told by her supervisor that he envisioned a promotion for her within the next twelve months and that she never got the promotion because that position was eliminated and that she was not qualified for a higher position even though she had excellent performance review. Perham also alleged that less qualified white men and women were promoted to higher positions and she believes this was because she is black. She also pointed out the lack of diversity at the top. Johnson and Johnson’s responded, â€Å"We have a deeply established commitment to diversity and incl usion in the workplace and deny the allegations in this case†(Gordon). There were two other cases, one in which an African American and one a Hispanic, filed similar lawsuits, accusing Johnson and Johnson of paying them lower wages and denying promotions to people of color. After ten years, that case was dismissed. Despite the fact that five of the highest-paid executives at Johnson and Johnson are white, four of them being men, and ten of the twelve directors are white with no women of color on the board, Calvert Investments still rated Johnson and Johnson’s diversity an 85 out of 100. These people know that the company would not want their reputation tainted so they make false claims to try and get whatever they can from the company. So the five highest paying executive in Johnson and Johnson may be white, but they also may be the most qualified, they may have worked the hardest to get to that point and they may be the most dedicated thereby deserving every dollar they earn. Although Johnson and Johnson met some challenges when they wanted to expand its Diversity and Inclusion initiative globally, they succeeded in meeting those challenges and the initiative was a success. Town hall meetings led by local leaders and web-based training reached several countries within the regions, live video conferences and live international video meetings were introduced and became groundbreaking for Johnson and Johnson. This resulted in improved employee morale, productivity and communication. They have diverse employees, market their products to diverse groups and have initiatives in place to expand lead their company diversity even further in the future.
